MOTRIN® Canadian One Club Golf Tournament – Official Rules and Regulations
THE FOLLOWING SWEEPSTAKES IS OPEN TO LEGAL RESIDENTS OF CANADA [EXCLUDING RESIDENTS OF THE PROVINCE OF QUEBEC] WHO ARE OF THE AGE OF MAJORITY IN THEIR PROVINCE/TERRITORY OF RESIDENCE (COLLECTIVELY, THE "ELIGIBILITY AREA"). YOU MAY NOT ENTER THIS SWEEPSTAKES IF YOU ARE NOT LOCATED IN, AND A LEGAL RESIDENT OF, THE ELIGIBILITY AREA, IF YOU ARE A PROFESSIONAL OR OLYMPIC GOLFER, OR YOU ARE AN EMPLOYEE OF OR RESIDE WITH AN EMPLOYEE OF THE PROMOTION ENTITIES DEFINED HEREIN. NO PURCHASE IS NECESSARY TO ENTER. ENTRY IN THIS SWEEPSTAKES CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES.
- 1) Eligibility: You must be a legal resident of the Eligibility Area and of the age of majority in your province of residence at the time of your entry. Void where prohibited by law. Employees and agents of Johnson & Johnson Inc. ("Sponsor"), Inventa Sales and Promotions, Edelman, its affiliates, advertising and promotional agencies, any other prize sponsor, and any entity involved in the development, production, implementation, administration or fulfillment of the Sweepstakes (all of the foregoing, together with Sponsor, collectively referred to as the "Promotion Entities"), and persons living in the same household as such individuals, whether related or not, are not eligible to participate or win.
- 2) How To Enter: The Sweepstakes begins at 12:01 pm Eastern Standard Time (hereinafter “EST”) on July 7, 2008 and ends at 11:59 pm EST on August 7, 2008 (the "Sweepstakes Period"). You may enter the Sweepstakes during the Sweepstakes Period as follows:
- a) Visit www.whichclubwouldyouuse.ca during the Sweepstakes Period and click on the 'MOTRIN® Canadian One Club Golf Tournament' Contest banners and/or links to access the online entry form.
- 3) Conduct: By entering the Sweepstakes, entrants agree to comply with and be bound by these Official Rules. The Official Rules will be posted at the Sweepstakes website throughout the Sweepstakes Period. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. Entrants further agree to comply with and be bound by the decisions of the judges, which will be final and binding in all respects. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be: (a) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or any Sponsor's website; (b) violating the Official Rules; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any Sponsor property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
- 4) Prizes:
- 1. Winners that are being flown in from out of province must be available to depart from their closest major commercial airport on Wednesday August 20th, 2008

- 6) General Conditions: This Sweepstakes is governed by the laws of the Canada. All federal, provincial and local laws and regulations apply.
- 7) Limitations of Liability: The Promotion Entities assume no responsibility for lost, late, misdirected, illegible, or mutilated entries, or for theft, destruction or unauthorized access to, or alteration of, entries. The Promotion Entities are not responsible for any incorrect or inaccurate information, whether caused by website users, any of the equipment or programming associated with or utilized in the Sweepstakes, or any technical or human error which may occur in the processing of submissions in the Sweepstakes. The Promotion Entities assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers, whether on account of technical problems, traffic congestion on the Internet or at any website, or on account of any combination of the foregoing. The Promotion Entities are not responsible for any injury or damage to participants or to any computer related to or resulting from participating or downloading materials in this Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Promotion Entities which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and select winners from among all eligible entries received prior to the cancellation. This process will be repeated until a winner has been confirmed for each prize.
- 8) Privacy: By entering the Sweepstakes, entrant: (a) grants to the Sponsor the right to use his/her name, photo, likeness, voice, telephone number, mailing and e-mail address (“Personal Information”) for the purpose of administering the Sweepstakes, including but not limited to contacting and announcing the Winner; (b) grants to the Sponsor the right to use his/her Personal Information for publicity and promotional purposes relating to the Sweepstakes, in any and all media now known or hereafter devised, without further compensation unless prohibited by law; and (c) acknowledges that the Sponsor may disclose his/her Personal Information to third-party agents and service providers to the Sponsor in connection with any of the activities listed in (a) and (b) above. The Sponsor will use the entrant’s Personal Information only for identified purposes, and protect the entrant’s Personal Information in a manner that is consistent with the Sponsor’s Privacy Policy, located at Privacy
- 9) Intellectual Property. All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned by the Sponsors and/or their affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited. MOTRIN⊃ and MY GAME MY PAIN⊃ are registered trade-marks of Johnson & Johnson Inc.
- 10) Discrepancy. In the event of any discrepancy or inconsistency between the terms and conditions of the Official Rules and disclosures or other statements contained in any Sweepstakes-related materials, including but not limited to the entry form, or point of sale, television, print or online advertising, the terms and conditions of the Official Rules shall prevail, govern and control.
The submission of an entry is solely the responsibility of the entrant. Entries may only be made according to the methods described above. Proof of sending (such as an automated computer receipt confirming delivery of email or "thanks for entering" message etc.) does not constitute proof of actual receipt by Sponsor of an entry for purposes of these Official Rules. Automated entries (including but not limited to entries submitted using any bot, script, macro, or sweepstakes service), copies, third party entries, facsimiles and/or mechanical reproductions are not permitted and will be disqualified. Only eligible entries actually received by Promotion Entities before the end of the specified entry period will be included in the prize drawing. Illegible, unintelligible, incomplete, garbled, lost, misdirected, or mutilated entries will be disqualified. All entries become the property of Sponsor, and none will be acknowledged or returned.
In the event of a dispute, entries received on-line shall be deemed to be submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an internet access provider, on-line service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Illegible entries, bulk drop-offs, mechanical reproductions or facsimile entries are ineligible.
Grand Prize: There will be a total of four (4) grand prizes available to be won, each consisting of: Entry for a pair (two (2) adults) to participate in the MOTRIN® Canadian One Club Golf Tournament held at St. Andrew’s Valley Golf Club in Aurora, ON to be held on Thursday August 21, 2008; Economy class airfare for two (2) people from the major commercial airport nearest the winner's residence to Toronto; One (1) standard double room for two (2) nights at the Sutton Place Hotel, transportation to the Sutton Place Hotel from Pearson International Airport in Toronto, ON and return on Friday August 22, 2008, transportation to and from the Cosmopolitan Hotel and Spa to St. Andrew’s Valley Golf Club, and $400 CDN total cash in spending money. Winner and travelling companion are responsible for ensuring they have the necessary travel documents and Sponsor and Inventa Sales and Promotions are not responsible in the event the winner and/or their travelling companions are refused boarding at any time by the airline or airport security and any unused portion of the prize will be forfeit. Approximate retail value of each prize $3,750 depending on the city and province of departure. If the winner resides within 300 KMS of Toronto, the airfare portion of the prize is forfeit and they are responsible for their own transportation.
The Grand Prize may not be transferred or assigned except by Sponsor as detailed herein. The Grand Prize must be accepted as awarded, without substitution, and is not transferable or convertible to cash and is not for resale. If a potential winner is unable to attend the event and / or transportation requirements they will forfeit the prize and another name will be drawn. Sponsor reserves the right in the event that the advertised prize (or any component thereof) cannot be awarded as described for any reason, to substitute another prize (or any component thereof) with another prize of equal or greater value without liability. Reporting and payment of all applicable taxes, fees, and/or surcharges, if any, arising out of, or resulting from, acceptance or use of a prize, are the sole responsibility of the winner of that prize. Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of the prizes awarded. Sponsor makes no representations or warranties concerning the appearance, safety or performance of any prize awarded. Restrictions, conditions, and limitations apply.
The restrictions, conditions and limitations are as follows:
The Promotion Entities will not replace any lost or stolen prize items.
PRIZE DRAWING: Four random draws for the Sweepstakes will be held at 9:00 am EST on Tuesday August 12, 2008 in Toronto, ON (“Draws”) by the Independent Judging Organization Inventa to select the potential Grand Prize winners (“Selected Entrant”) from among all eligible entries received during the Sweepstakes Period.
The following applies to all drawings: Odds of winning depend on the number of eligible entries received during the Sweepstakes Period. All prize drawings will be conducted by an independent judging organization whose decisions are final.
The Selected Entrants will be notified by telephone and/or email within 48 hours after the Draws. Before being declared an official winner, the Selected Entrant and Traveling Companion must sign a declaration and release form which releases the Sponsor and Promotion Entities and each of its respective shareholders, directors, officers, employees and assigns (the “Release Form”) and winner must have correctly answered, without assistance of any kind, whether mechanical or otherwise, the mathematical skill-testing question on the Release Form. The Release Form must be returned within the time period specified on the Release Form or the prize may be forfeited. The Sponsor will contact the winner within three (3) days of receipt of the duly completed Release Form to declare the Selected Entrant an official winner and arrange for delivery of the relevant prize. Return of any prize/prize notification as undeliverable, or inability of the Promotion Entities to contact a potential winner may result in disqualification and selection of an alternate eligible entrant by above noted random drawing.
In the event that: (a) the Selected Entrant cannot be reached within 48 hours of the Draw; (b) the answer to the mathematical skill-testing question is incorrect; and/or (c) the Selected Entrant does not complete the Release Form and return same within the time period specified on the Release Form, the prize will be forfeited and an alternate eligible entrant will be selected randomly by draw from the remaining eligible entries.
By entering, entrants: release and hold harmless Promotion Entities, and its respective parents, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, participation in this promotion, or while traveling to, preparing for or participating in any prize-related activity.
